Where is DFS permitted? Monitoring all 50 States for FanDuel and DraftKings
Sports betting has supplanted daily sports news in recent years.
However, there may be even more uncertainty surrounding the legality of DFS, as its operators have traditionally seen it as a “game of skill” rather than gambling.
Most states allow the use of DFS websites like DraftKings and FanDuel.
While some states have made it expressly lawful, others just haven’t made a decision and permitted it in accordance with their state’s current gaming laws.
DFS is still allowed in a few states, but DraftKings and FanDuel have departed those states to stay out of legal issues. Or, in Oregon, DraftKings stopped holding daily
sports competitions to protect its monopoly on sports betting there.
Alabama: Yes for DraftKings, Yes for FanDuel, and Some for Other Operators
After previously banned DFS, Alabama became the second state to legalize it again in 2019.
Alabama has among of the harshest gambling rules in the country, and as of June 2022, there will be no sports betting allowed.
Alaska: Yes; DraftKings; FanDuel; Other Operators; Yes Alaska does not have sports betting but does have daily sports. Even though the state has not formally legalized it, operators nonetheless run competitions.

In 2016, the Idaho attorney general outlawed daily sports at the same time as numerous other states passed legislation to permit them.

The Illinois Supreme Court’s ruling that daily sports (DFS) is not gambling was a sticking point for the majority of the industry in 2020.
Indiana

When three former college football players sued the operators for exploiting their names, images, and likeness without their consent, Indiana’s 2016 legalization of DFS came under scrutiny in 2018.
However, the Indiana Supreme Court sided with the owners, allowing those websites to keep running paid competitions.
College tournaments were no longer available from DraftKings and FanDuel for several years before they were reinstated in several areas in 2018.
Iowa
DraftKings, FanDuel, and other operators are all present.
Iowa legalized DFS in 2019, which was a little late to the party.
Kansas

DFS became authorized in Kansas in 2015 via House Bill 2155.

Despite the lack of formal DFS regulations in Kentucky, DraftKings and FanDuel are present.
Louisiana

As part of the 2018 election, Louisiana officially authorized DFS on a parish-by-parish basis (the state’s equivalent of counties), but it took years to issue the first license and start holding contests.

In 2017, Maine passed a DFS statute.
Maryland: DraftKings, FanDuel, and other operators all accept players.
Maryland authorizes the operation of DraftKings and FanDuel, but the state has cracked down on other “DFS” websites like PrizePicks, which enables parlay wagering on single player props.
Massachusetts

In 2016, DFS became allowed in Massachusetts, the state where DraftKings is based.
Michigan
FanDuel, DraftKings, and other operators are also present.
Due to a regulatory oddity, Underdog just left Michigan; nevertheless, DraftKings and FanDuel continue to operate there in defiance of local legislation.
Minnesota

Due to the fact that the state views DraftKings and FanDuel tournaments as gambling, Montana has banned paid games.
Nebraska
DFS is legal in Nebraska, but there is no official regulation. DraftKings, FanDuel, and other operators all provide it.
Nevada Nevada has historically been one of the more contentious DFS states. DraftKings, FanDuel, and Other Operators all refuse to operate there. A formal gambling license is required for websites like DraftKings and FanDuel to operate in the state after they were first ruled illegal.
FanDuel and DraftKings have opted to avoid Nevada rather than acknowledge that their DFS competitions involve gambling.
Hampshire, New
FanDuel, DraftKings, and other operators are also present.
DFS became lawful in New Hampshire in 2017.
Jersey, New
FanDuel, DraftKings, and other operators are also present.
In 2017, DFS became law in New Jersey, one of the states with the friendliest gaming laws in the nation.
New Mexico: DraftKings, FanDuel, and other operators all offer their services.
To formally legalize and regulate DFS, a bill was put up in 2016, but it never advanced.
New York: DraftKings, FanDuel, and other operators all offer their services.
Since DFS’s development in 2015–16, New York has been the site of controversies surrounding the industry.
In October 2015, Attorney General Eric Schneider man filed a lawsuit against the DFS owners, which caused them to temporarily leave the state. A bill was approved by the state legislature in 2016.
After that, a state judge decided in 2018 that DFS competitions are against New York’s gambling laws. However, an appeals court decided in March 2022 that daily sports are not gambling.
North Carolina: DraftKings, FanDuel, and other operators all accept players.
There are no formal DFS legislation in North Carolina.
North Dakota: Yes, DraftKings, FanDuel, and other operators
There are no established DFS legislation in North Dakota.

Utah has tight gambling rules, yet DFS providers nonetheless run paid competitions there.
Vermont

When Governor Terry McAuliffe signed the Contests Act in 2016, Virginia became the first state to fully authorize daily sports.

DFS is not permitted in Washington due to its tight gaming laws.
Washington D.C. FanDuel, DraftKings, and other operators are not available.
DFS tournaments are permitted in Washington, DC.
West Virginia: DraftKings, FanDuel, and other operators all offer their services.
Patrick Morrisey, the attorney general of West Virginia, stated in 2016 that DFS is not illegal there.
Then, in 2017, Morrisey published a ruling declaring that daily sports (DFS) are games of skill rather than chance (i.e., gambling), making them acceptable in the state.
Wisconsin: DraftKings, FanDuel, and other operators all offer their services.
